Terms and Conditions

1. Acceptance of Terms

These Terms and Conditions (“Terms”) govern your access to and use of the KC Eatz mobile application and website (the “App” or “Service”), operated by KC Lifestyle Girl LLC (“KC Eatz,” “we,” “us,” or “our”). By creating an account or otherwise using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Description of Service

KC Eatz is a digital dining club that connects members with participating Kansas City-area restaurants offering exclusive coupons, and separately displays promotional content from paying business sponsors. Guests may browse restaurant listings and sponsor promotions for free; a paid membership subscription is required to unlock and redeem restaurant coupons.

3. Eligibility

You must be at least 13 years old to create a KC Eatz account, or meet any higher minimum age required by applicable law. Certain content, advertisements, promotions, products, or services may be restricted to users who meet additional legal-age requirements. You may not access or interact with age-restricted content unless you satisfy the applicable age and legal requirements. KC Eatz is intended for use within the United States (Kansas City metro area), and we make no representation that it is appropriate for use elsewhere.

4. Account Registration

To access membership features, you must register with a valid email address and password and complete one-time-passcode (OTP) email verification. You are responsible for maintaining the confidentiality of your login credentials and for all activity on your account, and must notify us immediately of any unauthorized use.

5. Membership Subscription & Billing

5.1 Subscription Price

Membership is offered at the subscription price displayed to you at the time of purchase through the applicable App Store or Google Play purchase screen. Subscription fees are billed automatically each billing cycle until canceled. Pricing may change from time to time as permitted by applicable law and applicable app-store policies.

5.2 Payment Methods

Subscription purchases made through the iOS application are processed through Apple’s In-App Purchase system. Subscription purchases made through the Android application are processed through Google Play Billing. KC Eatz does not directly receive or store users’ full payment card information.

5.3 Auto-Renewal

Your subscription renews automatically each billing cycle unless you cancel before the renewal date. Canceling stops future renewals but does not refund the current billing period unless required by applicable law.

5.4 Price Changes

We may change our subscription pricing from time to time. Any price changes affecting an existing subscription will be communicated and implemented in accordance with applicable law and the policies and requirements of the applicable app store. Where required, you may be asked to consent to a price increase before it takes effect. If you do not agree to a required price change, you may cancel your subscription before the new price becomes effective.

5.5 No Refunds

Except as required by applicable law or applicable app-store policy, payments are non-refundable, including for partial billing periods or unused coupons.

5.6 Cancellation

Subscriptions purchased through Apple must be managed and canceled through the user’s Apple account/App Store subscription settings. Subscriptions purchased through Google Play must be managed and canceled through the user’s Google Play subscription settings.

Cancellation prevents future renewals but does not automatically entitle the user to a refund for the current billing period, except where required by applicable law or applicable app-store policy.

Deleting a KC Eatz account does not automatically cancel an active App Store or Google Play subscription. Users are responsible for separately canceling their subscription through the applicable app store.

6. Coupon Activation & Redemption

• Coupons are a membership benefit and have no cash value. They are personal to your account and may not be transferred, sold, screenshotted for resale, or shared with non-members.
• Before a coupon is activated, the App will display a confirmation substantially similar to: “Ready to redeem? Once activated, this coupon will expire in 10 minutes and may be considered used even if you do not present it to the restaurant.” You must affirmatively select “Activate Coupon” to proceed.
• Selecting “Activate Coupon” begins a 10-minute redemption window. During this window, you present the revealed code to restaurant staff. Once the window elapses, the coupon is treated as used, regardless of whether it was actually presented. Redemption relies on an honor system — restaurant staff are not required to scan or otherwise verify the code.
• Some coupons renew monthly with a new code; others are single-use or time-limited. Terms specific to each coupon (expiration, exclusions) are shown in the App and control over these general Terms where they conflict.
• We and our restaurant partners reserve the right to refuse redemption, limit quantities, or suspend or terminate accounts we reasonably believe are engaged in fraud or abuse (for example, screenshot-sharing or repeated unauthorized reuse of a code).

7. Restaurant & Coupon Responsibility

Participating restaurants are independently owned and operated and are responsible for honoring offers they have made available through KC Eatz, subject to the terms, exclusions, availability, and expiration applicable to each offer. KC Eatz cannot guarantee that any particular restaurant, coupon, promotion, or offer will remain available.

8. Restaurant & Food Liability

Participating restaurants and businesses are independent third parties and are not owned, operated, or controlled by KC Eatz. KC Eatz is not responsible for the preparation, quality, safety, availability, pricing, or delivery of food, beverages, products, or services provided by participating businesses, or for the acts or omissions of those businesses or their employees.

9. Food Allergies & Dietary Information

KC Eatz does not independently verify ingredients, allergen information, dietary classifications, food-preparation practices, or cross-contamination risks. Restaurant menus, descriptions, dietary labels, and similar information may be supplied by participating restaurants or other third parties.

Users with food allergies, sensitivities, or dietary restrictions should confirm relevant information directly with the restaurant before ordering or consuming any food or beverage.

10. Changes to Restaurants, Coupons & Service

Participating restaurants, businesses, coupons, promotions, membership benefits, and App features may be added, modified, suspended, replaced, or removed from time to time.

Membership does not guarantee continued participation by any particular restaurant or business or continued availability of any particular coupon, discount, promotion, or benefit. KC Eatz may modify or discontinue portions of the Service where reasonably necessary, subject to applicable law and app-store requirements.

11. Errors & Corrections

KC Eatz reserves the right to correct typographical, technical, pricing, coupon, promotional, or other errors displayed in the Service. KC Eatz or a participating business may cancel, correct, or modify an offer where information was displayed incorrectly or an obvious error has occurred, subject to applicable law.

12. Promotions & Sponsored Content

The App may display paid advertisements and promotional content from third-party businesses, including businesses offering age-restricted products or services such as alcohol or cannabis, where permitted by applicable law and platform policies.

Sponsored content is advertising and does not mean KC Eatz manufactures, sells, distributes, delivers, or directly facilitates transactions involving those products. Sponsored content is separate from the paid membership benefit and may be available to both members and guests, subject to any applicable age, location, legal, or platform restrictions.

Users must satisfy all applicable age and legal requirements before viewing or interacting with age-restricted content. KC Eatz may restrict, remove, or decline advertising based on age requirements, location, applicable laws, or Apple/Google platform requirements. KC Eatz does not endorse, guarantee, or assume responsibility for the products, services, or claims of any sponsor.

13. User Conduct

You agree not to:

• provide false registration information or impersonate another person;
• share your account credentials or coupon codes with non-members;
• attempt to reverse-engineer, scrape, or interfere with the App or its security;
• use the App for any unlawful purpose or in violation of these Terms;
• misuse the redemption or promotion features to defraud restaurants, sponsors, or KC Eatz.

We may suspend or terminate accounts that violate this section.

14. Intellectual Property

The App, including its design, branding (including the KC Eatz name and K+C emblem), text, graphics, and software, is owned by KC Lifestyle Girl LLC or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from it without our prior written consent.

15. Third-Party Services

The App relies on third-party services, including Apple’s In-App Purchase system, Google Play Billing, cloud hosting, and other app infrastructure providers, each of which has its own terms and privacy policies. We are not responsible for the acts or omissions of these third parties.

16. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY COUPON OR PROMOTION WILL BE HONORED BY A THIRD PARTY.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KC EATZ AND KC LIFESTYLE GIRL LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS BEFORE THE CLAIM AROSE.

Some jurisdictions do not allow certain exclusions or limitations of warranties or liability. Accordingly, some of the above limitations may not apply to you, and nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

18. Indemnification

You agree to indemnify and hold harmless KC Lifestyle Girl LLC, KC Eatz, and their respective owners, officers, employees, agents, contractors, successors, and assigns from any claims, damages, or expenses arising from your violation of these Terms or misuse of the App.

19. Account Termination

KC Eatz may immediately suspend or terminate an account where we reasonably suspect fraud, coupon abuse, unauthorized account or coupon sharing, security violations, unlawful activity, or material violations of these Terms. KC Eatz may otherwise suspend or discontinue accounts or portions of the Service upon reasonable notice where practicable, subject to applicable law. You may stop using the App and cancel your subscription at any time.

20. Governing Law

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles, unless otherwise required by applicable consumer protection law in your jurisdiction.

21. Changes to These Terms

We may update these Terms from time to time, including as our App, pricing, participating restaurants, coupons, advertising offerings, and business model evolve. Material changes will be communicated via the App or by email. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
